The Federal Employee Reform and Tort Compensation Act of 1988 protects federal employees from liability in their duties. If sued in state court, the Attorney General of the United States can certify the case for removal to federal court. Once certified, removal is mandatory and the employee is dismissed from the suit, with the federal government replacing him or her as the defendant. Then, the Federal Tort Claims Act, or other applicable law, governs.
